Terms and Conditions

These terms apply to spray refinishing work carried out by ProFinish Spray Transformations ("we", "us"), a sole trader business based in Luton, Bedfordshire. Your written quote forms part of the contract. Where the quote and these terms differ, the written quote takes priority.

Quotes

Guide prices given from photos are estimates. Your written quote confirms the surfaces, preparation, coating system, colours, sheen and price. It is valid for 30 days unless it states otherwise. Work that is not listed on the quote, such as repairs, cupboard interiors, hardware changes or extra colours, is only included if it is written on the quote. Any extra work is agreed and priced with you before it is carried out.

Deposit and payment

• A booking deposit of 30% of the quoted price is needed to secure your dates and order materials.
• The deposit is deducted from the final balance.
• Once the deposit is received, you can ask for a sprayed sample panel in your chosen colour where practical for the job.
• The balance is due on completion unless your quote sets out stage payments.
• If you cancel within the 14-day cancellation period, your deposit is refunded as set out below. If you cancel after the cancellation period, we may keep the part of the deposit that covers materials already ordered or mixed for your job and any costs we have reasonably incurred. Any remainder is refunded.
• If we need to move your booked dates, we will give you as much notice as possible and agree new dates with you. If no suitable dates can be agreed, your deposit is refunded in full.

Your written finish guarantee

On completion and full payment, you receive a written finish guarantee:

• Kitchens: 5 years.
• Exterior work (uPVC, front doors, garage doors and other outside surfaces): 3 years.
• Commercial work: as stated on your quote.

What the guarantee covers

The guarantee covers the finish we applied, specifically peeling, flaking, blistering or loss of adhesion caused by our preparation or application. If a covered problem appears, we will return to assess it and, where it is covered, repair or respray the affected area at no cost to you.

What the guarantee does not cover

• Accidental or impact damage, chips, scratches and dents after completion.
• Damage from harsh or abrasive cleaners, solvents, scourers or steam cleaners, or from cleaning or aftercare not in line with the guidance we give you.
• Heat damage, for example from kettles, toasters, ovens or hobs placed against or near sprayed surfaces.
• Water damage, swelling or failure of the underlying material, including units that later swell or leak.
• Movement, rot, rust, corrosion or structural failure of the surface underneath, and defects that were present before the work and noted to you.
• Normal wear and tear, and gradual colour change or fading from sunlight over time.
• Heat-related movement or distortion of very dark colours on south-facing or sun-exposed uPVC where you chose that shade after we had advised against it.
• Hinges, handles, locks, seals, glazing and other mechanisms or hardware.
• Surfaces that have been altered, repaired, drilled or repainted by anyone else after our work.
• Work that has not been paid for in full.

The guarantee is in addition to your legal rights as a consumer. It does not affect them. Under the Consumer Rights Act 2015, services must be carried out with reasonable care and skill.

Your right to cancel (14 days)

If you agree the contract with us at your home or away from our business premises, or at a distance (for example by phone, email or WhatsApp), you have a legal right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right applies to consumers, not business customers.

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right to cancel, you must inform us (ProFinish Spray Transformations, Luton, Bedfordshire, telephone 07871 908022, email jay@profinishluton.co.uk) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you.

We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you requested to begin the performance of services during the cancellation period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.

Starting work within 14 days

We will not start work within the 14-day cancellation period unless you expressly ask us to, in writing. If you do ask us to start early and then cancel, you pay for the work done up to the point you tell us, as set out above. If the work has been fully completed at your request within the cancellation period, you will no longer have the right to cancel.

Before and during the work

Please make sure we have clear access to the areas being sprayed and a power supply, and that cupboards and nearby areas are cleared as agreed. We protect and mask surrounding areas and clean up at the end of the job. Newly sprayed surfaces need time to cure fully, and we will give you aftercare and cleaning guidance at handover.

Liability and insurance

We hold £6m public liability insurance. Nothing in these terms limits our liability for death or personal injury caused by negligence, or any other liability that cannot be limited by law.

Governing law
